Conditions

preliminary remark:
The general terms and conditions are the basis for business transactions with our customers at the German locations of von PMP Immobilien GmbH & CoKG. They ensure that the conclusion of the contract is simplified, accelerated and standardized through a pre-formulated set of rules. For merchants within the meaning of the HGB, they also apply to future business relationships without the need for an express agreement.

§ 1 Confidentiality

All information and documents provided by us, including our property records, are intended exclusively for our customers and may only be passed on to third parties with the written consent of PMP Immobilien GmbH & CoKG. Culpable violations may oblige the person passing on to pay damages if a main contract (rental/purchase contract) is concluded.

§ 2 data protection

The client expressly agrees that PMP Immobilien GmbH & CoKG is authorized to process the necessary personal data of the client in accordance with the statutory provisions in order to fulfill its obligations.

§ 3  truthfully
The customer undertakes to provide all information and data required to carry out an order completely and correctly. Furthermore, the customer undertakes within the scope of an issued sole contract not to commission any other broker during the term of the contract.
If the customer of PMP Immobilien GmbH & Co. KG already knows the property offered, he undertakes to inform PMP Immobilien GmbH & Co. KG of this immediately. If a corresponding notification of prior knowledge is not made within the period, the customer cannot invoke the prior knowledge.

§ 4 Accuracy

In the event that a part of these GTC or a clause of these GTC is ineffective, this does not affect the validity of the rest of the GTC. The resulting gap is intended to be closed by the law .

§ 4  Limitation of Liability

We would like to point out that the property information we pass on, documents, plans etc. come from the seller or landlord. We therefore accept no liability for the correctness or completeness of the information. It is therefore the responsibility of our customers to check the property information and details contained therein for accuracy. Otherwise, von PMP Immobilien GmbH & CoKG is only liable in the event of intent, gross negligence, the absence of guaranteed properties or culpable violation of a cardinal obligation. Otherwise according to the legal regulations.

Liability for the services of third parties is not accepted. This applies in particular if the company PMP Immobilien GmbH & CoKG - without legal obligation - arranges contracts between its customers and third-party companies, e.g. B. Construction contracts, work contracts, financing contracts, etc. PMP Immobilien GmbH & Co. KG assumes no liability for the services of the recommended or brokered companies.

§ 5  accuracy

The company PMP Immobilien GmbH & Co. KG and its customer agree that the place of performance and place of jurisdiction, as far as legally permissible, is the registered office of the company PMP Immobilien GmbH & Co. KG in Daun.
In the event that a part of these GTC or a clause of these GTC is ineffective, this does not affect the validity of the rest of the GTC. The resulting gap is intended to be closed by the law.
